1. Introduction and Acceptance of Terms
These Terms and Conditions (the “Agreement”) govern the rental, leasing, or use of vehicles, equipment, and related services provided by DROLLY LLC, operating under the RentMe Orlando brand (the “Company”).
By signing a rental agreement, using a vehicle, or making payment, the Customer acknowledges that they have read, understood, and agree to be legally bound by these Terms and Conditions.
Submitting an online rental request does not guarantee availability or create a completed rental. A rental is formed only after the Company accepts the request and the Customer signs the applicable vehicle-specific rental agreement.
2. Definitions
“Company” means DROLLY LLC, operating under the RentMe Orlando brand, and its owners, officers, employees, contractors, and affiliates.
“Customer” or “Renter” means the person or entity signing the rental agreement and any authorized drivers.
“Vehicle” means any automobile, truck, trailer, equipment, or other motor vehicle rented or provided by the Company.
“Rental Period” means the time from vehicle pickup until the vehicle is returned and inspected by the Company.
3. Driver Eligibility Requirements
To rent or operate a vehicle provided by the Company, the Customer must:
- Be at least 21 years of age unless otherwise specified.
- Possess a valid driver’s license appropriate for the vehicle class.
- Provide proof of identity and address.
- Meet applicable insurance requirements.
Commercial drivers must also comply with applicable federal motor carrier safety regulations, including driver qualification standards under 49 CFR §391 requiring valid commercial licenses and safe driving qualifications.
4. Compliance with Federal and Florida Law
All Customers must comply with applicable federal and Florida laws while operating the Vehicle. Where applicable, this includes:
- Federal Motor Carrier Safety Regulations.
- Florida traffic laws.
- Drug and alcohol testing rules for commercial drivers.
- Commercial driver’s license requirements.
- Driver qualification, training, and screening requirements.
Failure to comply may result in immediate termination of the rental agreement.
5. Payment Terms
The Customer agrees to pay all charges applicable to the rental, which may include:
- Daily, weekly, or monthly rental charges.
- Mileage and fuel charges.
- Late-return and cleaning fees.
- Damage or repair charges.
- Administrative processing fees.
All charges must be paid in U.S. dollars. The Company may charge the authorized payment method on file for outstanding amounts related to the rental, subject to applicable law and the signed rental agreement.
6. Security Deposits
A security deposit may be required before the rental. The amount depends on the selected Vehicle and other disclosed rental details.
The deposit may be applied to damage repairs, late-return charges, traffic or toll violations, cleaning costs, unpaid rental balances, and other authorized charges.
Any unused portion will generally be refunded within 7-14 business days after the Vehicle is returned and inspected. Processing time may also depend on the payment provider.
7. Chargeback and Payment Dispute Protection
- The Customer authorizes the Company to charge the authorized payment method for valid charges related to the rental.
- The Customer agrees to contact the Company first and make a good-faith effort to resolve a payment dispute before initiating a chargeback.
- If a chargeback is initiated without a valid reason, the Customer remains liable for the underlying rental charges and, where permitted by law and the signed agreement, chargeback processing fees and legal costs.
- The Company may provide rental agreements, identity-verification records, signatures, Vehicle records, and GPS records to payment processors or financial institutions to investigate or contest fraudulent or inaccurate chargebacks.
8. Vehicle Use Restrictions
The Customer agrees that the Vehicle will not be used for:
- Illegal activities or transporting illegal substances.
- Racing, reckless driving, or any unlawful use.
- Carrying hazardous materials without authorization.
- Towing without the Company’s prior permission.
- Subleasing or renting the Vehicle to third parties.
- Operation by an unauthorized, unlicensed, impaired, or otherwise ineligible driver.
Violation of these restrictions may result in immediate termination and lawful recovery of the Vehicle.
9. Maintenance and Responsibility
The Customer must maintain proper fuel levels, monitor the Vehicle’s condition, and report mechanical issues, warning lights, or other problems immediately.
The Customer is responsible for damage caused by negligence, misuse, or unauthorized drivers, subject to applicable law and the signed rental agreement.
10. Accidents and Damage
If an accident occurs, the Customer must:
- Contact law enforcement immediately when required or appropriate.
- Notify the Company within 24 hours.
- Provide accident reports, photographs, witness details, and insurance information reasonably requested by the Company.
Failure to report an accident or cooperate with the investigation may result in liability for damages to the extent permitted by law and the signed rental agreement.
11. Insurance Requirements
Customers must maintain valid insurance coverage during the Rental Period. Required coverage may include liability, property-damage, and collision coverage.
If the Customer does not have qualifying coverage, the Company may offer optional protection packages. Coverage labels, prices, exclusions, limits, deductibles, claims procedures, and eligibility are controlled by the applicable documents presented for the rental.
12. Repossession Rights
The Company may lawfully recover the Vehicle if payment is overdue, the Vehicle is used illegally, the rental agreement is materially violated, or the Vehicle is abandoned.
Recovery may occur without judicial process only where permitted by Florida law and without a breach of the peace. The Customer is responsible for authorized repossession, towing, and recovery costs to the extent permitted by law and the signed rental agreement.
13. Traffic Violations and Tolls
The Customer is responsible for traffic tickets, parking fines, tolls and toll violations, towing charges, and impound fees assigned to the rental. Administrative processing fees may apply where disclosed and permitted.
14. Negligent Operation and Liability
The Customer accepts responsibility for the safe and lawful operation of the Vehicle. The Customer must ensure that all authorized drivers are qualified, properly licensed, and listed in the signed rental agreement.
15. Background Checks and Identity Verification
The Company reserves the right, subject to applicable law, to conduct identity verification, driving-record checks, and other eligibility or background screening reasonably related to rental safety and legal compliance.
16. Employment Eligibility if Drivers Are Provided
If drivers are provided through staffing or employment services, verification of legal employment eligibility may be required under Florida and federal law, including use of E-Verify where applicable.
17. Indemnification
To the extent permitted by law, the Customer agrees to indemnify and hold harmless the Company from claims, damages, losses, or legal actions resulting from Vehicle misuse, driver negligence, violations of law, or third-party claims attributable to the Customer or an authorized or unauthorized driver.
18. Limitation of Liability
To the maximum extent permitted by law, the Company will not be liable for lost profits, business interruption, indirect damages, or consequential damages arising from the rental or use of the Vehicle. Nothing in this section excludes liability that cannot legally be excluded.
19. Termination of Agreement
The Company may terminate the Agreement when its terms are violated, required payment is not made, fraud is reasonably suspected, or termination is otherwise permitted by the signed rental agreement or applicable law.
20. Dispute Resolution
The parties will first attempt to resolve disputes through good-faith negotiation, followed by mediation if agreed or required. Unresolved disputes may be litigated in the state or federal courts with jurisdiction in Orange County, Florida, unless applicable law or a signed agreement requires otherwise.
21. Governing Law
This Agreement is governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law principles.
22. Entire Agreement
These Terms and the signed vehicle-specific rental agreement constitute the agreement between the parties regarding the rental and supersede prior statements or agreements on the same subject. If a vehicle-specific agreement conflicts with these general website terms, the signed vehicle-specific agreement controls for that rental. If any provision is unenforceable, the remaining provisions continue in effect.
